Terms of use

These terms apply to the use of the Samen Clean app and this website. By creating an account you agree to them. Please also read our privacy policy. In case of differences between this translation and the Dutch version, the Dutch version prevails.

1. Who are we?

Samen Clean is offered by Zoutmanstraat 15, 2202 LK Noordwijk · KvK 42022140: name, legal form, address, Chamber of Commerce (KvK) number, email address. In these terms we call this "we" or "us".

2. What is Samen Clean?

Samen Clean is an app that lets you try to break a habit or addiction within a small group of friends (2 to 8 people). You check in daily, keep streaks, earn XP, levels and badges and can send an emergency alert to your group.

3. Not medical care

• Samen Clean is a tool for peer support. It is not a medical device, does not diagnose and does not give treatment advice.
• Stopping some substances, such as alcohol, can be medically risky. Talk to your doctor.
• Group members are friends, not care providers. There is no guarantee that anyone will respond to an emergency alert.
• In an emergency, call 112 or your local emergency number. If you're having thoughts of suicide, contact a crisis line in your country (in the Netherlands: 113 via 0800-0113).

4. Age and account

• You must be 18 or older to use Samen Clean. We ask for your year of birth when you sign up.
• Your data is stored encrypted on your device. You don’t need an email address. Keep your recovery code safe: without it nobody can get your data back, including us.
• You are responsible for what happens with your account through your device.

5. Rules of use

Use Samen Clean respectfully. You may not:

• intimidate, threaten, insult or pressure others;
• encourage anyone to relapse or to harm themselves;
• choose a nickname or group name that is offensive, discriminatory or misleading, or that contains someone else's real name without permission;
• share group members' data outside the app without their permission;
• misuse the emergency button or notifications, for example to spam;
• disrupt, hack, scrape or use the app or our servers for anything other than their intended purpose;
• use the app for illegal activities, such as dealing in substances.

You can report a group member in the app. We may review reports and, if these rules are broken, restrict or end your access to a group or your account. A group's creator can remove members from the group.

6. Free and Plus

• The core of Samen Clean is free: your group, the emergency button, check-ins, streaks, levels, badges, tips and helplines.
• Samen Clean Plus is an optional subscription with extra features, such as several habits at once, all themes right away and full statistics. The app shows which features are part of Plus.
• You subscribe to Plus through the App Store (Apple) or Google Play (Google). Payment, renewal, any trial period and refunds are handled by them and are subject to their terms. You see the price in the app before you confirm.
• A subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
• You cancel in the subscription settings of your App Store or Google Play account. After cancelling you keep Plus until the end of the paid period. Deleting your account does not cancel a subscription automatically.
• If you bought Plus on another device, you can restore your purchase via Restore purchases in the app.
• Price changes are announced in advance through the App Store or Google Play, under their rules.

7. Availability and changes

• We do our best to keep Samen Clean working well and securely, but we cannot guarantee that the app always works without interruption or errors, or that push notifications (delivered via Apple, Google and Expo) always arrive on time.
• We may change the app, add or change features and carry out maintenance. We will announce material changes to Plus that are to your disadvantage in advance.
• If we discontinue Samen Clean, we will announce it in the app at least 30 days in advance so you can download your data.

8. Intellectual property

The app, texts, design and tips belong to us or our licensors. You receive a personal, non-transferable right to use the app for your own, non-commercial use. What you enter yourself (such as your nickname or your "why") remains yours; you only allow us to process it to make the app work.

9. Liability

• You use Samen Clean at your own responsibility. You make decisions about your health yourself, preferably together with a doctor.
• We are not liable for damage caused by relying on the app, tips or messages from group members, or by a notification not arriving or arriving late.
• Insofar as we are liable, our liability is limited to the amount you paid for Plus in the 12 months before the damage, up to a maximum of € 100.
• These limitations do not apply in case of intent or deliberate recklessness on our part, nor to the extent the law (for example consumer law) does not allow them.

10. Deleting your account and termination

• You can delete your account at any time via Settings → Delete account. This is immediate and final. Remember to cancel any active Plus subscription separately.
• We may restrict or end your account if you seriously or repeatedly break these terms, or if the law requires it. Where possible, we will tell you why first.

11. Changes to these terms

We may change these terms. We will announce material changes in the app in advance. If you don't agree with the new terms, you can delete your account.

12. Governing law and disputes

These terms are governed by Dutch law. Have a complaint? Contact us first via Zoutmanstraat 15, 2202 LK Noordwijk · KvK 42022140 and we'll look for a solution together. As a consumer you keep the protection of the mandatory rules of your country of residence and can also go to the competent court where you live.
